Terms of service and sale
These terms govern products and services provided by TX Merry Lights LLC, doing business as TX Merry Lights, through the website, online supply shop, quote planner, and customer-project experience. By placing an order or approving a proposal, you agree to these terms and any project-specific terms shown in the accepted proposal.
Eligibility and authority
You must be able to enter a binding agreement and provide accurate information. If you act for a business, property owner, tenant, association, or other organization, you represent that you have authority to request the work, approve the proposal, and authorize reasonable access to the property.
Quote requests are not purchases
Submitting an address, preferences, or contact details creates a request for review. It does not guarantee availability, set a final price, reserve an installation date, or create an obligation to purchase.
Custom quotes, plans, and payment
Every inquiry receives a custom quote based on the property and requested display. TX Merry Lights does not publish one-size-fits-all installation pricing, has no minimum project price, and does not require a deposit as part of the current service model. Current payment methods are credit card, debit card, or Zelle. The accepted proposal controls the final amount, included work, schedule, materials, and payment timing. Approving a proposal records acceptance and a payment preference but does not itself charge a payment.
Non-refundable custom services
A quote request is free and is not a purchase, so there is no quote-request fee to refund. Once a customer approves a project and TX Merry Lights begins custom planning, measuring, design, scheduling, material procurement, fabrication, installation, in-season maintenance, or removal work, amounts paid for that project are non-refundable. Completed installations and delivered custom plans are not refundable. If a service concern arises, the remedy is review and, when appropriate under the accepted scope, correction or completion of the contracted work rather than a refund. This section does not apply when TX Merry Lights cancels paid work without performing it or when applicable law requires a different remedy.
Supply-shop orders
Online product purchases may be coordinated with a custom installation project, but product and service charges are separately quoted and accepted. An order does not include design, custom fitting, installation, maintenance, or removal unless those services appear in a separately accepted quote. Product availability is based on the latest supplier inventory check and may change before checkout. TX Merry Lights reviews and manually places paid merchandise orders with an independent product supplier, which may ship the order directly to the delivery address you provide. If a material listing, availability, or pricing error is discovered, we may contact you to approve a correction or cancel and refund the affected item or order.
Prices, tax, and payment
Store prices are shown in U.S. dollars. Texas orders are charged the owner-confirmed 8.25% sales-tax rate on the taxable order amount after the delivery address is validated. For destinations outside Texas, applicable sales tax is collected only where TX Merry Lights is registered and required to collect it. Product orders of $100 or more receive free commercial FedEx Ground shipping. Orders below $100 are charged a flat $14.27 Ground shipping fee, with no separate order-handling fee. The total shown for your submitted order is the amount sent to Authorize.net for authorization and capture. A payment may be held for review or declined by the payment provider. We do not receive or store your full card number or security code.
Promotions and welcome-offer eligibility
Supply-shop orders with a merchandise subtotal of $1,000 or more automatically receive 15% off eligible merchandise before sales tax is calculated; shipping, tax, service invoices, and separately quoted installation work do not count toward the $1,000 threshold. No code is required. Discounts do not stack: if another valid product promotion applies, checkout uses the single larger eligible discount. One-time welcome codes may also apply to eligible products or professional installation and removal services, and their eligibility is checked against the current cart or quote before payment.
Shipping
Supply orders of $100 or more ship free by commercial FedEx Ground to U.S. addresses. Orders below $100 are charged one flat $14.27 Ground shipping fee. There is no separate handling fee. Checkout validates package measurements, the delivery address, and parcel-carrier limits before payment; freight-only packages may require a separate quote. Paid orders normally arrive 2–3 business days after ordering, including processing and transit. Weather, carrier interruptions, remote destinations, holidays, supplier availability, and address problems may cause delays. If an order cannot ship within the promised period, we will provide the updated estimate and cancellation or refund option required by applicable law. Cancellations, returns, and order problems
Contact us promptly if you need to cancel an order; cancellation is not guaranteed after supplier purchasing or fulfillment begins. Unopened products with intact factory packaging may be returned within 30 days after delivery when we approve the return before it is sent. Opened electrical or electronic products are not returnable for preference-based reasons. The opened-package restriction does not prevent review of products that arrive damaged, incorrect, incomplete, or not working. Unless the return results from our error or an approved damaged or defective-product claim, the customer is responsible for return shipping and any original shipping charge is not refundable. The full process appears in our return and refund policy. Nothing in this section limits rights that cannot legally be waived.
Product information and safe use
Product descriptions and specifications are based on supplier information available when the catalog is imported. Packaging and minor appearance details may change. Follow all manufacturer instructions, electrical ratings, compatibility requirements, and local safety rules. TX Merry Lights does not manufacture the products; any manufacturer warranty is subject to that manufacturer's terms.
Measurements, mockups, and estimates
Remote measurements and visual mockups are planning tools based on available imagery and customer-provided information. Roof access, hidden elevations, field conditions, requested changes, or inaccurate information may require the scope or price to be adjusted before work begins.
Seasonal service
Installation, in-season maintenance, and removal are included in the current service model, and the customer stores the lights after removal. Response expectations, exclusions, access requirements, and other project details will be stated in the accepted quote or service agreement.
Appointment scheduling
Customers with an approved or previously discussed service may reserve an available installation, maintenance, or removal arrival window through the website or a private project link. A reservation is tied to the contact and service-address information submitted. Arrival windows are estimates rather than exact arrival times; weather, traffic, prior-project conditions, safety, access, and operational needs may affect timing. Please provide safe property access and promptly cancel or contact us if the appointment needs to change. TX Merry Lights may reschedule when conditions prevent safe or practical work and will communicate the updated window.
Customer project access
You are responsible for keeping the secure link to your project private and for providing accurate contact and property information. Notify TX Merry Lights if you believe project access has been compromised.
Address lookup
Address suggestions use Google Maps Platform and are also subject to the Google Maps/Google Earth Additional Terms of Service.
Website use
Do not misuse the website, attempt to access another customer’s project, upload unlawful or malicious content, interfere with the service, or use automated methods that place an unreasonable burden on the system.
Website and product-content availability
We may correct website errors, update product information, limit quantities, reject fraudulent or unauthorized activity, or suspend features for maintenance or security. Website availability and product availability are not guaranteed. These terms do not exclude warranties, remedies, or consumer rights that cannot legally be excluded.
Intellectual property
The TX Merry Lights name, branding, original website design, written content, project mockups, and original media may not be copied, republished, or commercially reused without permission. Product names, brands, specifications, and approved product imagery may belong to their respective owners.
Limitation of responsibility
To the fullest extent permitted by law, TX Merry Lights is not responsible for indirect, incidental, special, or consequential loss arising from website use, carrier delay, customer-selected incompatibility, improper installation by others, misuse, modification, or use contrary to manufacturer instructions. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
Governing law and severability
Texas law governs these terms, without regard to conflict-of-law rules. Any permitted court proceeding must be brought in a court with jurisdiction where TX Merry Lights maintains its principal business location. If a provision is found unenforceable, the remaining provisions continue in effect.

Changes
These terms may change as our products, services, or legal obligations change. The version in effect when an order is placed or a proposal is approved governs that transaction unless applicable law requires otherwise. The current revision date appears above.
